NZRC eCommerce Terms & Conditions

1.0    Introduction Why we have these Terms

These Terms & Conditions ("Terms") govern the purchase of First Aid products via the New Zealand Red Cross ("NZRC") eCommerce website. By placing an order, you agree to be bound by these Terms, NZRC’s Privacy Policy, and applicable New Zealand legislation.

2.0    Definitions                                                                       

• "NZRC" refers to New Zealand Red Cross Incorporated.
• "Goods" means First Aid products available for purchase via the NZRC eCommerce website.
• "Purchaser" means any individual or entity placing an order for Goods.
• "Website" refers to the NZRC eCommerce platform.

3.0    Ordering & Payment              

• All orders are subject to acceptance and availability.
• Prices are listed in New Zealand Dollars (NZD) and include GST unless otherwise stated.
• Payment must be made in full at the time of ordering via approved payment methods.
• NZRC reserves the right to cancel or refuse orders at its discretion.                                                                 

4.0 Delivery & Shipping                                 

Dispatch Timeframes Orders are typically dispatched within two (2) business days. However, processing times may be extended during peak periods or if items are on indent, back order, or pre-order.

Delivery Partners Shipments are fulfilled via:

·         New Zealand Post – standard orders and most parcel deliveries

·         Mainfreight – large, oversized, or palletised deliveries.

·         Delivery time frames are indicative only and subject to carrier updates or service variations.

Important Notes:

• Delivery is available within New Zealand only.
• Risk and title in the goods passes to the purchaser upon dispatch.
• NZRC is not liable for delays caused by third-party carriers.
• Dangerous Goods includes any items containing Lithium-ion batteries.

5.0 Returns & Refunds 

If you receive goods that are faulty, damaged, or not as described, please notify NZRC within seven (7) days of receipt. Requests must include:

• Your order number
• A description of the issue
• Supporting documentation (e.g. photos, proof of purchase)

NZRC will assess the request and may, at its discretion, offer a repair, replacement, or refund. Items must be returned in original condition and packaging unless otherwise agreed.

Please note:

·        Change-of-mind returns are not accepted

·        Returns sent without prior approval will not be processed

·        NZRC is not liable for delays or loss during return transit

6.0 Product Guarantees

• Goods are supplied for personal or workplace use, not for resale unless by prior arrangement.
• Business purchasers may not be covered by certain consumer protections under the Consumer Guarantees Act 1993.
• NZRC does not guarantee uninterrupted availability of specific products.

7.0 Use of Information

• NZRC collects and uses personal information in accordance with its Privacy Policy.
• By purchasing Goods, you consent to the collection and use of your data for order fulfillment, communication, and compliance purposes.

8.0 Electronic Communications

• By providing your email address, you consent to receiving order confirmations, updates, and promotional communications.
• You may opt out of marketing emails at any time via the unsubscribe link in the email.
• NZRC complies with the Unsolicited Electronic Messages Act 2007.

9.0 Liability & Disclaimers

• NZRC is not liable for indirect, incidental, or consequential loss arising from the use or inability to use the Goods.
• NZRC accepts no responsibility for damage caused by:

·         Installation by unqualified / unapproved tradespeople

o    Improper or non-standard installation

o    Use outside intended purpose

·        Repairs,  or modifications, or servicing using non-approved components or conducted by unauthorized/unqualified or unapproved persons.

• Nothing in these Terms limits rights under the Fair Trading Act 1986 or Consumer Guarantees Act 1993.
• NZRC’s liability is limited to the original purchase price of the Goods.
• NZRC is not liable for indirect, consequential, or incidental damages arising from any breach.

NZRC reserves the right to update these Terms at any time. Changes will be posted on the Website.

10.0 Governing Law

These Terms are governed by the laws of New Zealand. Any disputes shall be subject to the exclusive jurisdiction of New Zealand courts.
